These terms govern your access to and use of Systivate's website and services, including ADA Website Fixer. By using our site or services, you agree to these terms.
The service
Systivate provides website accessibility auditing and remediation, including automated scans, reports, and code fixes delivered as a WordPress child theme or similar deliverable. We may add, change, or discontinue features at any time.
Eligibility and accounts
You must be able to form a binding contract to use the service, and you agree to provide accurate information. You are responsible for the activity that occurs through your requests and for maintaining the confidentiality of any credentials we issue.
Orders, payment, and refunds
Prices are shown at the point of purchase and are payable in advance unless stated otherwise. Because the service delivers a completed audit and remediation, refunds are handled on a case-by-case basis. If we fall short of delivering a usable result for your site, contact us and we will make it right.
Acceptable use
You agree to use the service properly: submit only sites you are authorized to audit, leave the service free from disruption or reverse engineering, and respect the rights of others and every applicable law.
Your site and content
You retain ownership of your website and content. By requesting an audit you grant us permission to access and analyze the public pages of the site you submit for the purpose of providing the service. You are responsible for backing up your site before applying any remediation we provide.
Intellectual property
The service, our software, reports, and deliverables (excluding your own content) are owned by Systivate and licensed to you for use on the site you purchased them for. Reselling or redistributing them requires our written permission.
Legal advice and guarantees
Our audits and fixes are designed to improve conformance with the Web Content Accessibility Guidelines (WCAG) and to reduce accessibility barriers. They are provided for informational purposes only and fall short of legal advice. We offer zero guarantee of compliance with the Americans with Disabilities Act or any other law, and zero guarantee of immunity from any claim or lawsuit. Disclaimers and limitation of liability
The service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Systivate's total liability arising out of or relating to the service is capped at the amount you paid us for the service giving rise to the claim, and Systivate carries zero liability for indirect, incidental, or consequential damages.
Changes to these terms
We may update these terms from time to time. Material changes take effect when we post the updated terms on this page, and your continued use of the service constitutes acceptance.
Governing law
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules.
