These Terms of Service ("Terms") govern your use of Kairos and related services provided by Systivate LLC ("we," "us," or "our"). By using our services, you agree to these Terms.
1. Services
Kairos is a GTM automation platform that helps users identify prospects, generate personalized messaging, and manage outreach. Features and availability may change as we develop the product.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement to use our services. By using Kairos, you represent that you meet these requirements.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, providing accurate and current information, and notifying us immediately of any unauthorized access.
4. Acceptable Use
You agree not to use our services for any unlawful purpose, send spam or unsolicited communications in violation of applicable laws, attempt to gain unauthorized access to our systems, interfere with or disrupt our services, or violate any applicable laws including CAN-SPAM, GDPR, or CCPA.
5. Intellectual Property
All content, features, and functionality of Kairos are owned by Systivate LLC and protected by intellectual property laws. You retain ownership of any data you provide. By using our services, you grant us a license to use your data solely to provide and improve Kairos.
6. Disclaimer of Warranties
Kairos is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure. We make no warranties regarding the results you may obtain from using Kairos.
7. Limitation of Liability
To the maximum extent permitted by law, Systivate LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
